***Clarification on SMP Contract: It is Supplementary Manpower service contract job in which prospective applicants are interviewed and salary determined by NEOM interview panel; and being employed under the payroll of SMP Contract (SMP Vendor). ROLE OVERVIEW
A detail-oriented and organized Worker Welfare Standards Compliance Assessor is needed to support NEOM’s fast-paced and highly dynamic worker welfare team. The incumbent will conduct worker welfare audits, inspections and monitoring of contractors’ compliance to NEOM’s Worker Welfare Standards.
The incumbent will play a key role in ensuring that contractors and subcontractors to NEOM and other relevant stakeholders are complying with the requirements of the NEOM Workers Welfare Standards
This role is a necessity to enable the construction activity in accordance with NEOM’s guidelines and policies, and without the incumbent’s role, NEOM’s assets cannot be brought to the location and condition necessary for it to be capable of operating in the manner intended by management. This activity means that the roles are directly linked to the delivery of built assets at NEOM.
REQUIREMENTS SUMMARY
The Worker Welfare Associate SMP responsibilities will include, but not be limited to:
- Upholding NEOM Welfare Standards, ensuring compliance with labor laws and regulations to protect workers’ rights and promote fair and safe working conditions.
- Ensure Contractors and sub-contractors are aware of and fully implement NEOM Worker Welfare standards.
- Undertake investigations into complaints and issues, document the end-to-end process, develop and issue comprehensive and accurate reports, maintain all data and records related to individual cases
- Present fact-based evidence based on interviews, employer records, electronic data review.
- Conducting worker welfare assessments, including reviews of ethical recruitment, employment practices, assessments of accommodation and transportation facilities, worker interviews, inductions, as well as assessments of project site welfare facilities.
- Reviewing Worker Welfare Management Plans from contracting parties and educating on areas of improvement. Ensuring plans are regularly updated in line with changing scope and number of Workers
- Inspect locations, transportation and undertake worker interviews during on-site investigations to identify possible violations of the NEOM Welfare Standards to prevent potential incidents.
- Conducting routine spot check inspections to ensure compliance.
- Undertake remediation against contractors who are in violation ensuring that rapid resolution is provided.
- Evaluating Information to determine compliance with standards, development of corrective actions, nonconformity notifications and remediation plans.
- Ensures the compliance of employment related obligations including by meeting with employers/contractors, conducting on-site interviews, auditing submitted certified payrolls, and verifying proper classifications on employees.
- Prepare and review reports for Director’s analysis and make recommendations.
- Coordinates times, schedules, and dates with other inspectors to perform ongoing inspections or investigations.
- Maintain oversight of all issues of concern, ensure issues are logged and coordinate with appropriate managers to rectify the issues while maintaining the close‐outs timeline.
- Deliver feedback and training to Contractors and their suppliers to drive further compliance.
- Advises Contractors, Stakeholders and Workers during on-site investigations regarding implementation of NEOM Welfare Standards.
- Meets with Contractor Welfare Representatives on a monthly basis to review performance, evaluation remediation and to provide key updates.
Analyzing Data or Information:
- Analyses information/documentation received from workers, witnesses, and contractors regarding allegations of non-compliance with NEOM Worker Welfare Standards.
- Analyses the time and attendance records of the identified workers in line with contracts, offer letters, and WPS.
- Collects and audits follow up documentation to ensure non-compliance issues have been resolved
- Analyses and reviews statutory required documents that should be included in personnel file.
- Uses data to management and meet own KPI’s in relation to case resolution expectations
- Uses data adequately to identify trends and areas for improvement
- Correctly collects, documents and stores data and information in line with company Data Protection Policies and local legislation.
Updating and Using Relevant Knowledge:
- Gains and maintains knowledge of Worker Welfare Local and International practices
- Conducts research manually and electronically to maintain up-to-date information pertaining to inspections, rules, and regulations.
- Identifies problems and recommends solutions to prevent future incidents, including root cause analysis.
- Utilizes internal escalation processes effectively and in a timely manor to bring issues to a rapid close.
Training and Teaching Others:
- Advising contractors, workers, and other stakeholders on good practices and compliance with relevant welfare standards, international requirements, ILO ratifications and local legislation
- Conducts outreach training programs educate contractors, workers and internal stakeholders
- Explains labor laws and standards, alongside penalties for violations to individuals, employers, and other interested parties.
- Interacts with NEOM Legal department to ensure correct interpretation and application of relevant Laws and standards.
- Schedules and conducts mediation between contractors and workers.
- Evaluates success of outreach / capability building activities in line with contractor performance and implementation.
- Undertakes evaluations on contractor representatives with feedback on fact / evidence based interactions.
Documenting/Recording Information:
- Creates and maintains case files containing all necessary information (i.e., reports, letters, pictures, employee/employer submittals, interview statements), during the investigation/inspection process in the audit systems system(s) on a case-by-case basis.
- Creates electronic audit reports when conducting compliance investigations.
- Utilizes approved letters and written documentation to communicate with workers and/or contractors in the investigation or complaint resolution.
- Responds to inquiries from workers, contractors, sub-contractors, internal stakeholders and other parties concerned by telephone, e-mail, fax, in person, or in writing.
- Correctly logs own time allocations against each contractor and reports on a monthly basis.
Establishing and Maintaining Interpersonal Relationships:
- Continually work with support staff, peer investigators, Directors, and other team members on a daily basis.
- Attends team meetings, workshops, and training conferences to attain additional continuing education.
- Provides information necessary to other divisions when conducting investigations or inspections.
- Communicates with cross functional teams regarding current inter-related areas of enforcement and statutory changes that may apply.
Making Decisions and Solving Problems:
- Analyzes information and documentation to determine compliance with statutory requirements.
- Makes decisions, recommendations, and solves problems in relation to inspection criteria.
- Evaluates and interprets documentation to determine the best solution and course of action to resolve problems.
- Makes decisions regarding conflict of interest when conducting inspections (i.e., acceptance of gifts or gratuities, personal relationships, etc.).
Organizing, Planning, and Prioritizing Work:
- Schedules inspections and investigations.
- Prepares a variety of records and reports and maintains files of investigative information collected from various sources.
- Makes recommendations based on inspection or investigation findings to division Director for assessment of warning and/or penalties.
- Enters time and expense reports into departmental system.
- Maintains and secures a copy of all reports at the work location for future reference/follow up or future investigation.
- Creates and/or submits weekly accomplishment report for all investigations
EXPERIENCE & QUALIFICATIONS
Knowledge, Skills and Experience
- Degree qualified (degree can be substituted for 7 years relevant work experience)
- A minimum of 5 years’ experience in a related field
- A valid driving license
- Own expert knowledge on Labor laws, ILO, IFC Performance Standard 2, Prevention of Modern Slavery Topics for seamless application.
- Excellent command of written and spoken business English
- Highly Desirable
- Qualifications in the field of Social Accountability / Migrante Labor such as SA 8000, Ethical Recruitment or International Labor Organization formal training
- Interview and investigation techniques with a range of individuals from varying backgrounds and education levels.
- Additional languages including one or more of the following: Mandarin, Hundi, Urdu, Tagalong, Sinhala, Pashto, Persian Arabic, Bengali, Punjabi, Tamil, Nepali, Malay, Swahili
Qualifications
- Hold at least a bachelor’s degree or Diploma in related field- / Welfare / Audit and or accounting (or equivalent qualifications)
- Minimum 5-8 years' experience in (industry & role) or in the relevant field of expertise.
- Must possess valid KSA drivers’ license
